Following the recent Annual Dialogue 2022 conducted by Suruhanjaya Syarikat Malaysia (SSM) on 6 October 2022, SSM provided the presentation slides and Summary of Issues and Feedback for the public.
"Notification of Change in the Register of Directors, Managers, and Secretaries (Section 58)" is one of the issues that have been addressed.
Before the Companies Act 2016, you will need to provide official documents of your business for processing, whether you are opening a business bank account or applying for a grant or loan. Most of the time, these required documents are called:
Form 9,
Form 13,
Form 24,
Form 32A, etc.
Notification of Change in the Register of Directors, Managers, and Secretaries under section 58 is similar to the old Form 49.
This Notification of Change in the Register of Directors, Managers, and Secretaries (Section 58) document should be submitted to SSM whenever there are any changes in managers, directors or company secretaries of the company.
However, there are certain government agencies and financial institutions that still require Form 49 and claim the reason that a copy of the notice under Section 58 of the Companies Act 2016 is not recognised to complete the criteria for list check or registration. This occurs in dealings with government agencies like the Customs and Immigration Service.

Feedback:
SSM knows about the situation and will take appropriate measures, including contacting the appropriate agencies, to make sure that it is resolved.
Simultaneously, SSM will continue to make announcements and provide briefing sessions for government agencies, Local Authorities (PBT, Pihak Berkuasa Tempatan), and other related agencies to ensure the latest information on the act's requirements is communicated to the agencies.
